General Terms and Conditions

1. General

RESPEKTRUM® Britta Reichard carries out coaching and the moderation of modules and workshops in accordance with these General Terms and Conditions (GTC). These terms and conditions are deemed to have been accepted upon commissioning. Deviations from these GTC must be agreed in writing.
The contracts concluded with RESPEKTRUM® Britta Reichard are service contracts. The subject of the contract is the provision of the agreed services, not the achievement of a specific result. In particular, RESPEKTRUM® Britta Reichard does not owe a certain economic result. Opinions and recommendations prepare the decision of the client, but cannot replace it in any case.
RESPEKTRUM® Britta Reichard is entitled to use assistants, expert third parties and other vicarious agents to perform a service. RESPEKTRUM® Britta Reichard does not offer consulting services in legal and tax matters. These services are to be provided by the client.
RESPEKTRUM® Britta Reichard provides the services on the basis of the data and information provided by the client or his authorized representatives. The guarantee for factual correctness and completeness lies with the client.

2. Offers/Fees

The offers of RESPEKTRUM® Britta Reichard are subject to change. The fees are quoted in Euros plus VAT, unless otherwise stated. For coaching and moderation services, the fees specified in the agreement will be charged. Travel costs and travel time within the city of Munich shall be reimbursed at a flat rate of EUR 75. Travel costs outside Munich (travel costs, travel time, additional meal expenses, accommodation costs and incidental travel expenses) shall be charged on a time and material basis (2nd class rail travel or a rate of EUR 0.95 per kilometers driven in a car). Other agreements require the written consent of RESPEKTRUM® Britta Reichard. The client is the debtor of the fee, irrespective of whether a cost commitment from another source exists. Fees are due after invoicing without deduction according to the payment term. Withholding or offsetting the fee is only permitted if the client's claims are recognized by RESPEKTRUM® Britta Reichard or have been legally established.

3. Cancellation of appointments

It is possible to cancel a coaching session free of charge up to 7 days  before the appointment. Cancellations at shorter notice or no-shows must pay the fee for two coaching hours.
In the case of modules or workshops, refunds will be made if written notice of cancellation is received up to 90 days before the start of the session. Reimbursement will be made less the generally non-refundable accommodation and catering costs and the conference fee. In the case of individuals, a one-off transfer of registration to another person will be accepted up to 30 days before the start of the module or workshop. If a module or workshop does not take place for reasons for which RESPEKTRUM® is responsible, we will refund the workshop or module fee paid. Alternatively, we will rebook you for another RESPEKTRUM® event at your request, taking into account the workshop or module fee paid. No further claims can be made. A meaningful and efficient implementation is only possible if the participants attend all module/workshop dates. There is no entitlement to compensation for a missed module/workshop day.

4. Copyright

Unless otherwise agreed, all documents handed over to the client are included in the fee. RESPEKTRUM® Britta Reichard holds the copyright to the documents. Reproducing documents or parts thereof in any form and/or making them accessible to third parties is only permitted with the written consent of RESPEKTRUM® Britta Reichard.

5. Insurance cover and liability

Participation in coaching or modules/workshops requires normal mental and physical resilience. Coaching and modules/workshops are not psychotherapy and do not replace it. The client and the client are fully responsible for themselves and their actions within and outside of coaching and modules/workshops. The client is liable for any damage caused. The information and recommendations in coaching and modules/workshops as well as in all documentation have been carefully considered and checked by the coach. Liability is excluded. The client and the client have no insurance cover from RESPEKTRUM® Britta Reichard. The dispatch or electronic transmission of any data is the responsibility of the client.

6. Confidentiality

RESPEKTRUM® Britta Reichard undertakes to maintain unlimited confidentiality towards third parties about all operational, business and private matters of the client that become known in the course of the activity, even after the termination of the contract. In addition, RESPEKTRUM® Britta Reichard undertakes to carefully store the documents provided for the purpose of coaching and modules/workshops and to protect them against inspection by third parties.

7. Obligation of the client to cooperate

Coaching and modules/workshops take place on the basis of the preparatory discussion between the parties. They are based on cooperation and mutual trust. Coaching and modules/workshops are free, active and self-responsible processes. Certain successes cannot be guaranteed. The coach is available to the client as a process facilitator to support decisions and changes. The actual change work is carried out by the client. The client should be willing and open to dealing with themselves and their situation.

8. Final provision

Changes or additions to the contents of the contract are only effective if confirmed in writing by RESPEKTRUM® Britta Reichard. Should individual provisions of the contract with the client, including these GTC, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.

9. Place of jurisdiction

The place of jurisdiction is Munich. The law of the Federal Republic of Germany shall apply.
